Coaching / Training / Consulting Work
The following Terms of Engagement apply as soon as you have confirmed an engagement with Kristen Lisanti LLC/Mind by Design. They are designed to provide clarity and peace of mind for you and for us. If you have any questions about them, please don’t hesitate to ask.
1.1 These terms clarify the agreement between Kristen Lisanti LLC and the client for the provision of coaching, training or consultancy services.
1.2 These terms are designed to protect the rights of all parties for all work performed and to align mutual expectations of engagement and are shown openly to form our contracted conditions of work.
2.0 FEES AND EXPENSES
2.1 Fees are agreed at the time of engagement and are not subject to change unless stated in writing.
2.2 For work requiring travel outside the greater Los Angeles area, travel expenses plus the shipping of any related materials will be charged to the client on the final invoice, unless otherwise stated. Kristen Lisanti LLC will always strive to keep these costs to a minimum.
2.3 Payment is usually charged 50% at the time of engagement (this is non-refundable) and 50% upon completion of the project or coaching engagement unless otherwise stated in writing.
2.4 Payment is due within 30 days of the invoice date unless previously agreed in writing with the client. Delayed payment will incur a late-payment fee which will be 5% of the invoice total for each period of 30 days that payment is delayed. Kristen Lisanti LLC reserves the right to suspend any further work for the client in this case..
2.5 Final invoices are issued by Kristen Lisanti LLC within a week of project completion. Where multiple sessions or deliverables have been booked across several weeks/months, Kristen Lisanti LLC may issue separate invoices after each key deliverable, in accordance with a timeline to be established with the client at the time of engagement.
2.6 Payment is accepted by check or credit card. In the instance of payment by credit card, additional charges incurred as a result will be added to your invoice.
3.1 Reports, documents and counsel from Kristen Lisanti LLC to the client are for the sole use of the client and should not be divulged to third parties without the prior consent of Kristen Lisanti LLC.
3.2 Confidential information provided by the client for the delivery of the project by Kristen Lisanti LLC will not be divulged to third parties without the prior consent of the client.
4.0 PROPERTY RIGHTS
4.1 Both parties will safeguard each others’ respective intellectual property so that any ideas, documents and proprietary rights will be the assigned property of the initiating author.
4.2 Kristen Lisanti LLC and the client may publish project successes to share learning outcomes with relevant parties. Consent will be sought from any individuals before publishing names or any other details.
5.1 Kristen Lisanti LLC will work to agreed objectives on the basis that these do not imply warranties or guarantees.
5.2 Work is reliant on information and support from the client and Kristen Lisanti LLC is not liable for any consequential losses.
5.3 Kristen Lisanti LLC performance is subject to the timely supply of support information and facilities by the client.
5.4 Liability for any loss or damage sustained by either party as a result of the performance or non-performance of work shall be limited to the amount of the payments falling due under this agreement.
6.1 In the event of a terminated engagement, the initial 50% payment is non-refundable. Additional cancellation fees may apply under the following circumstances:
Less than two weeks before a scheduled event or training
More than six weeks completed of a 12-week coaching engagement
6.2 All out-of-pocket expenses incurred by Kristen Lisanti LLC on behalf of the client shall become payable irrespective of the date of termination.
Class Registration Policy
Registrations are accepted online, by mail and phone, or walk-in. Registration is not guaranteed until payment is received. Registration with payment is strongly encouraged as class sizes are limited and do fill quickly. If you pre-register without payment and the class fills, you will be notified and placed on a waitlist.
Refund and Cancellation Policy
Refunds requested prior to two weeks before the first day of class will be assessed a $25 administrative fee. We regret that we cannot give refunds after this date. Refunds should be requested by email to firstname.lastname@example.org.
Please honor our refund policy.
Postponing a Class: Credit towards a future class will be provided if a registrant notifies us by phone or email in advance of 5PM on Friday of the first week of the class series. Future class must be the one immediately following the missed class series. NO EXCEPTIONS. For example: If postponing a May/June class series you will have to use your credit and enroll in theJuly/August class series.
Make-up Class: If you miss a class, you may make up ONE class within the current series at your level only. No refund or prorate will be issued for missed classes.
We reserve the right to cancel classes due to low enrollment. Registrants will be notified in advance of the class.
No refunds or credits are given to registrant “no-shows."
Refunds for payments made by check may take longer to process.
Information Collection, Use, and Sharing
We are the sole owners of the information collected on this site. We only have access to/collect information that you voluntarily give us via email or other direct contact from you. We will not sell or rent this information to anyone.
We will use your information to respond to you, regarding the reason you contacted us. We will not share your information with any third party outside of our organization, other than as necessary to fulfill your request, e.g. to ship an order.
Your Access to and Control Over Information
You may opt out of any future contacts from us at any time. You can do the following at any time by contacting us via the email address given on our website:
- See what data we have about you, if any.
- Change/correct any data we have about you.
- Have us delete any data we have about you.
- Express any concern you have about our use of your data.
We request information from you on our order form. To buy from us, you must provide contact information (like name and shipping address) and financial information (like credit card number, expiration date). This information is used for billing purposes and to fill your orders. If we have trouble processing an order, we'll use this information to contact you.
We take precautions to protect your information. When you submit sensitive information via the website, your information is protected both online and offline.
Wherever we collect sensitive information (such as credit card data), that information is encrypted and transmitted to us in a secure way.
While we use encryption to protect sensitive information transmitted online, we also protect your information offline. Only employees who need the information to perform a specific job (for example, billing or customer service) are granted access to personally identifiable information. The computers/servers in which we store personally identifiable information are kept in a secure environment.
